High-net-worth families have the extraordinary opportunity of gifting $5,120,000 per person through the end of 2012 as part of the tax code�s lifetime gift exemption (For 2011 the amount was $5,000,000; the gift tax applicable exclusion amount is adjusted for inflation after 2011. The inflation adjusted amount for 2012 is $5,120,000.) The tax rate is 35 percent for 2012, however, the gift tax applicable exclusion amount drops to $1,000,000 with a 55 percent tax rate after 2012 unless Congress takes further action. Still many are not taking advantage of the opportunity.
